As long as you are the regd owner of a vehicle, you are responsible for all deeds and misdeeds

When you exchange your earlier car at the dealer point while buying a brand new Maruti/ VW/ Toyota/ Hyundai/ Mahindra/ Tata or any other car of your choice, you don't sell to Maruti True Value or whoever. Although the value of your erstwhile car has been adjusted with that of your new car, in legal terms you have simply handed over (not sold) your earlier car to a channel partner of  Maruti, etc. You might even possess a delivery note with date and details of chasis number and engine number of your earlier car.
However, the sale is NOT over till such time mParivahan continues to show your name as the legal owner of your old car.
Maruti True Value, VW DasAuto, Toyota Trust, etc are plain and simple no better than the hole in the wall pre-owned car dealers which have opened shops all India. The onus is on you to ensure that the ownership change takes place at the earliest.
Personally, I will never want to sign on the dotted lines of Forms 29 and 30 unless the name of the buyer is filled in and signed copies of proof of address and identity of the buyer of my earlier car is handed over to me.
If you feel that I am over reacting or am scaring you unnecessarily, you are wrong. Even after a decade or more you might land yourself in untold worries. Friends, I personally want you to remain safe.

Exchanging old automobiles in lieu of a new one needs careful documentation so as not to repent later

Exchanging car/ two-wheeler in lieu of a spanking new or more advanced brand/ model/ variant is not as easy as two friends exchanging chocolates in lieu of yummy tiffin in school. Nor is it as easy as exchanging a 10 years old fridge in lieu of a more technologically advanced brand of fridge at any brown goods outlet.

Did you 'exchange' your old car in lieu of a brand new one at a car manufacturing company authorised branded pre-owned outlet, viz. True Value, Das Auto, Toyota Trust, etc?

The sale of your old vehicle is NOT over till such time mParivahan continues to show your name as the legal owner of your old vehicle.

You will be held responsible for all deeds and misdeeds pertaining to vehicles which figure in your name in mParivahan.

Caution: Remember the American consulate shootout in Kolkata where a blue Maruti 800 was used?
Remember the ki*lling of a coal mafia in Shaktigarh by hired shoo*ters?
In both the cases, the cars used were bought by criminals from pre-owned car dealers. The registered owners were innocent common citizens who were just happy to hand over their pre-worshipped cars to a pre-owned car dealer without caring to ensure if their own name has  been deleted from the records.

Don't believe in the verbal 'HUM TOH HAI NA' assurances by pre-owned car dealers!

P.S: We do not have details of a proposed rule where the pre-owned dealer or the buyer will be accountable once the original owner hands over the vehicle after the delivery note is exchanged.

I, Deep Banerjee (Founder - #IndianRoadie and #AssociatedForumsOfIndianRoadie) am the only one in India who have repeatedly stressed that buying and selling a pre-owned car/ bike is not as easy as buying/ selling a pack of cookies or a samosa or a sachet of shampoo or discarding a used cond*m. I have repeatedly stressed that buying and selling deals should not be done via one of those roadside or branded pre-owned car dealers, including the branded ones authorized by new car manufacturers.
A blue Maruti Baleno was used to bump off erstwhile coal smuggler Raju Jha near one of the 'lyangcha' selling shops on NH19 in Shaktigarh, East Bardhaman district, West Bengal. After the job was over, the goons drove off and discarded the car somewhere near Shaktigarh Police Station, as per media reports.
A resident of Baisnabhghata Patuli Township area in the southern fringes of Kolkata who was the first owner of the 2017 make blue Baleno has revealed to the Press that he sold off his 5 yrs old Baleno car to Car Dekho (a pre-owned car buying/ selling chain) in end September 2022 without obviously filling up the complete details in Form 29 and 30. The seller in pink t-shirt in the video thought that he had cracked a great deal and that his App based used car dealer will find a buyer and complete the name transfer process because ₹10,000 was held back.

Slogging it out to find a direct buyer was too much of labour for him like thousands and thousands of other tech-savvy callous roadies. The car was not yet transferred to a new owner on the date of the crime. However, it was used by the goons to bump off Raju Jha in Shaktigarh.
With everyone wanting to do everything (including producing babies) using Apps or knowledge gathered from YouTube, WhatsApp, etc this had to happen.

Where are those guys who in every warning post open up a wrong orifice of their body to say that such incidents don't happen daily. I wish they face such harrowing times atleast once before they breathe their last. I also earnestly want them to face the music for ignoring my warnings pertaining to #NoPlannedNightDriving.

All the super busy superhero roadies pan-India speak behind my back for all my well meaning warnings because my advice comes for free.

The original owner of the Baleno (WB06P3454) giving out the Press bite in the accompanying video link is trying to put up a brave face, but somewhere down below, his pants must be dripping wet!

Pre-owned car dealers are crooks of the highest order

For those of you'll who are planning to buy a pre-owned car from a used car dealer, the attached poster is for them.
Never trust them by their glitzy showroom, sugar coated words, and the shining cars on display. There's never a good and honest pre-owned car dealer anywhere in India.
If you don't have the time, patience and intellect to find a direct seller who's the present owner,  abort the idea of owning a pre-owned car of any model.
Ignore the 'Indian Roadie Hacks' at your own peril.
