Delhi High Court on 2019-04-10 allowed carmakers to take CCI to NCLT over landmark ₹2,544-cr anti-consumer fine

Carmakers allowed to take CCI to NCLT over landmark ₹2,544-cr anti-consumer fine
In a potentially far-reaching move, the Delhi High Court on 2019-04-10 allowed car companies in India to move NCLT challenging Competition Commission of India's (CCI) ₹2,544 crore penalty on them.
The penalty pertains to a high-profile case that had alleged 14 car companies of abusing their dominant position vis-a-vis component makers, which it said was helping these companies make exorbitant profits at the cost of car owners.

The companies have been given six weeks' time to approach the NCLT over the matter.

It was in August 2014 that the CCI had imposed the combined penalty on 14 carmakers for indulging in unfair practices in the spare parts market, in an almost unprecedented verdict in India's corporate history.

The companies fined by the CCI are Tata Motors, Maruti Suzuki, Mahindra & Mahindra, General Motors, Honda Car India, Honda Siel, Volkswagen India, Fiat India, BMW India, Ford India, General Motors, Hindustan Motors, Mercedes–Benz, Nissan Motors, Skoda Auto India and Toyota Kirloskar.

Scarce spare parts:
Tata Motors had been slapped with the maximum fine of Rs 1,346 crore, followed by Maruti Suzuki at Rs 471 crore, Mahindra & Mahindra at Rs 292 crore, General Motors at Rs 85 crore and Honda Car India Rs 78 crore.

CCI had held that these auto indulged in anti-competitive practices as they did not make genuine spare parts freely available in the open market.

The case goes back to January 2011, when one Shamsher Kataria complained to CCI that three carmakers — Honda, Volkswagen and Fiat — were abusing their position in the market by following a restricted policy on auto parts. He alleged that these companies were selling spares only through their dealers and not in the open market.

Not just this, Kataria also alleged that these companies were also preventing their auto component suppliers from selling stuff in open market. These companies were earning extraordinary margins through such a policy, he had alleged.

The CCI later expanded the probe to all carmakers in India that are listed by Society of Indian Automobile Manufacturers. In its hearing in 2014, it it largely upheld the allegations: carmakers implicitly controlled the spare-parts business and were really making extraordinary margins.

Carmakers' defence
The car companies, who questioned all along the extension of the probe to the entire industry, argued that they have a restrictive spare-parts policy to make sure customers buy only genuine parts. Fakes are widely available in the market and authories are unable to stop sale of fakes, they said.

"If the order of CCI were to be implemented fully, there will be risks of mishandling of electronic parts by untrained garages, leading to serious consequences to life of consumers and vehicles, and consumers tricked into buying fake parts at retail shops under the impression of buying genuine parts,” said Maruti boss RC Bhargava.

The case that started it all
One of Shamsher Kataria's submissions was that the cost of servicing a car in a non-company garage was up to 50% less than in a company-owned workshop. However, car owners were forced to go to company-owned workshops because carmakers don’t readily share spares with non-company ones. Car companies were using this situation to make sky-high profits, he had alleged.

In defence of the carmakers, Maruti's Bhargava said companies like his pick and choose who to sell their parts through precisely because they are looking out for consumers like Kataria. He cited an ACMA survey which had found that fakes — imitations of sub-standard quality — accounted for 36% of all auto parts sold in India by value.

To upsize tyres so that overall GC of car increases, which size should you opt for

Let's say that you own a car with low ground clearance (GC).
Let's imagine that the car came with stock tyres the size of each being 175/65/R15.

If your intention is to upsize the tyres so that the overall GC of the car increases, which size should you opt for 🤔

Your options are:
1) 175/65/R15, the side profile will remain unchanged, viz. 65% of 175 mm = 113.75 mm.

2) 185/65/R15, the new side profile would be 65% of 185 mm = 120.25 mm.

3) 195/60/R15, the side profile would be 60% of 195 mm = 117 mm.

There's a noticeable difference between 185 section and 175 section tyres in terms of ultimate ground clearance increase.

However, please note that these upgrades vis-a-vis stock tyres are not recommended by most car manufacturers. The revolution per minute (RPM) of the wheels will get distubed and the calibrated speedometer reading will differ from the actual speed.

It should also be borne in mind that if the overall diameter of the wheels are not changed while changing the width of the tyres only, the readings on the consoles might not show much error.

Iconic landmark of Durgapur, the coal gas holder of DPL razed in January 2022

The coal gas holder of the now shut down state owned Durgapur Projects Ltd (DPL) erected during end of 1950s was razed to the ground in end January 2022.

The structure was an iconic landmark of the industrial city of Durgapur.

I vividly remember that as a youngster (in 1960s and 1970s) when my parents used to drive us from our hometown in Barakar to my uncle's place in Durgapur (a distance of 45 odd kms) in that miniature rock solid Standard Super 10 Deluxe car 3 - 5 times a year, I used to get excited on spotting the huge structure from the G.T.Road near DVC More. As we would approach Gammon Bridge after turning right from G.T.Road the huge barrel shaped structure would become clearly visible on our right. After crossing Gammon Bridge there was a large circumference roundabout and the roadie in me from a very young age knew that our destination, viz. DN320, Coke Oven Colony was just a couple of minutes away.

My last visit to the DPL factory where my uncle was serving as an accounts officer was in June 1984 while I was doing my summer internship for Berger Paints India Ltd during my b-school days.

Mumbai to Jalandhar via Delhi - Road trip in November 2021

Road trip from Mumbai to Jalandhar (Mumbai_Jalandhar) by  and wife and 2 yrs old kid in November 2021.

Day 1 (10/11/2021): Mumbai - Udaipur

Mumbai - Surat - Vadodara - Halol - Godhra Bypass - Modasa - Rishabdev - Shamalaji - Udaipur.

Started sharp at 5 am from Kharghar, Navi Mumbai, and was at Ghodbunder Road by 5.45 am. Got badly stuck there for almost an hour and wasted precious time early in the morning. From there on, it was a breeze and the roads were in good condition until Surat toll. Had an hour's break for breakfast at Hotel Jalaram. Started at 11.30 am from Jalaram. The road is awesome throughout the stretch until Halol. From there on, the roads are smooth but 2 lanes until Godhra with a few bad rumblers and a few bad patches here and there. This particular stretch had a bit of local traffic and surprisingly tolls were exempted all the way from VBTL, Vadodra till Khandi Obri, Udaipur. We passed several tolls between Vadodra and Udaipur and all of them had exempted lanes for LMV. The next stop was directly at Hotel Sarvottam, Modasa at 4 pm with a brief refueling halt around 3.30 pm at Malpur. This was a quick break and started around 4.30 pm for the last stretch. As soon as we touch Samalaji on NH48, the roads were delicious. These last 160kms from Shamalaji till Udaipur was the best I've driven so far. There was smooth stretch throughout however, this particular section had proper markings, reflectors, inclinations and the smoothness was at another level. Reached hotel at Udaipur around 6.30 pm.
Distance --> 758 kms
Total hours 13.30 hours and Driving time 11.45 hours
Toll paid --> 640/-
-------------------------------------------------------------------
Day 2 (11/11/2021):  Had a day for relaxing as my wife and I was traveling with a 2yr old. Explored Udaipur a bit, went to City Palace, Lunch at Natraj thali, and evening at rooftop cafes.
-------------------------------------------------------------------
Day 3 --> Nov12 --> Udaipur - New Delhi

Udaipur - Nathdwara - Rajasmand - Beawar - Kishangarh - Jaipur - Neemrana - Gurugram - Delhi
Started at 5.10 am from the hotel and once we reached Sukher, there is some construction work on both sides and hence the stretch is a single lane for a few km. Once you cross that, the roads are smooth till Nathdwara and once we get onto Rajasmand, it's a lonely stretch all the way till Rajiyawas I think and the roads change drastically after that to 3-4 lanes on each side. Amazing stretch from here on till Jaipur. We had an hour's breakfast halt at Hotel NH8, Kishangad around 9.30 am and started again at 10.30 amThere was a lot of city/local traffic at Jaipur and once we enter the diversion towards New Delhi, the stretch gets a bit dusty with good roads. The stretch doesn't have any speed signage or at least I didn't notice any and so beware of speed traps over here. I got fined for overspeeding above 80kmph. Lunch halt at Hotel Highway King around 1.30 pm and resumed for Delhi around 2.30 pm. From here on, the stretch was boring all the way till Gurugram. There was some diversion at the RJ-HR border near Bawal and so follow the traffic and you'd be fine. There was city/local traffic all the way from Bawal to New Delhi. Reached relatives house at 6.15 pm.
Distance --> 656 kms
Total hours 13 hours and Driving time 10.45 hours
Toll paid --> 810/-
-------------------------------------------------------------------
Day 4 --> Nov13 --> New Delhi - Jalandhar
Route --> Delhi - Murthal - Panipat - Karnal -Ambala - Ludhiana - Phagwara - Jalandhar.
Started a bit late today at 8 am and reached Murthal around 9.30 am after a few diversions at the Singhu border. Roads are in good shape once the protest camps are done and there are still a few diversions and traffic till in-between Panipat and Karnal. After Karnal, it's a breeze with butter-smooth roads all the way till Jalandhar. We crossed a few toll booths but paid no toll as none were operational. Reached home around 3.45 pm.
Distance --> 373 kms
Total hours 7.45 hours and Driving time 6.45 hours
Toll paid --> None
There was no checking or stopping at any state borders for RT-PCR or Vaccine report check and it was a breeze all the way from Mumbai to Jalandhar. Only the hotel where we stayed at Udaipur asked for a vaccine certificate. Since we both were fully vaccinated, no issues at all.

Hyundai Creta owner in Punjab spotted overspeeding

The owner of the Hyundai Creta SXO (whose video is attached) is NOT a member of Indian Roadie or any of the associated forums. Going by his FaBo profile, he has some connections in Canada and Punjab.
Around 2022-01-23 he has posted in another forum on social media a video of himself driving on some National Highway in North India at breakneck speed with only his right hand casually holding the steering. The left hand is definitely not on the steering wheel, because in all probability he was recording his heroic act of overspeeding. A bhangra tune was blaring from the car's music system!
He claims to have driven 3000+ kms within one month of purchase. The irresponsible guy has proudly announced that he's thoroughly enjoying his drives in his new machine on four wheels.
Little does he know that his act of stupidity is a sure receipt of disaster for other road users and himself.

Bus rams into truck - fallout of not being High On Cognition

The bus rear ended a truck which braked suddenly at a road intersection.
A clear case of the bus driver not  being High On Cognition, so similar to the driving style of new age roadies.

If it were the new age roadies driving their cars in place of the bus, after ramming the truck they would have started blabbering nonsense for/ against the build quality of their cars, blah, blah, blah. The first thing they would have done is calling the truck driver an 'idiot'. Unfortunately, the Detroit returned automobile experts don't have the intellect to infer that Build Quality Of Drivers Brain Matters the most.

MORTH directives for validity of PUC certificates

The directives by MORTH about PUC certification are clear and specific. There's very little ambiguity.
- For the 1st one year after registration of a new car, you don't need to get PUC done.

- For BS4 and BS6 cars, PUC certificates need to be obtained after every 12 months.

Please keep this post handy with you while you are there on road. Cops in any state don't frame their own PUC compliance rules.

I don't use Gordhop navigation maps while driving

I don't use Gordhop navigation maps.

I had gone to a premium school years ago.
I have not forgotten the Geography my school teachers taught me 45 yrs ago in the same way that I have not forgotten that to stop a car it's BRAKE and 'not' BREAK. I clearly remember that my teachers would thrash me black and blue if I would have written that one needs to TASTE the urine before TESTING rasogollas or gulab jamuns during a drive.
I am in Kolkata but drive extensively all over the country with the same brain that God embedded into my top storey. I don't need a device or an App to tell me the route from BBD Bag to Salt Lake Stadium or Dumdum and the fanciful ETAs. I don't need a dumb screen with a moving dot/arrow while driving from Kolkata to Asansol or Delhi or Udaipur or Vizag or Khamgaon or Bargarh or Rewa.
Faridabad has remained where it was 35 years ago as much as Vizianagram, Jeypore, Mirzapur and Keonjhar all of which have not moved an inch. At the most they have expanded or shrunk.
For a drive from Kolkata to Varanasi I will not want people to laugh at me by proudly proclaiming that my wife or daughter was the navigator staring at a moving blue dot for the entire stretch of 680 kms.
Way back in the 1960s/ 1970s, money in dad's pocket was very limited. One could not have imagined getting into an engineering college with even a rank of 2239 whereas present day roadies with locked social media profiles claim to be diagonal leads or vertically down leads in tech 'startups' after scoring a fantastic JEE rank of 2,32,339. The qualified uneducated techies are supposedly so tech savvy that they will leave no stones unturned to sermonize you that one should embrace technology and drive under a smooth 4 lane concrete bridge instead of driving over it because that's what the Gordhop brayed.
When in doubt, I just need to stop and chat with a truck or cab driver by the roadside for the best route and its condition. In extreme situation, I might just switch on one of those Gordhop Maps in large and congested cities to check out the route from Mahim to Veera Desai Road or from South Extension ll to Mahipalpur, transfer the image to the device on my top storey and drive on.

'Chena Bamuner Poiter Dorkar Pore Na'!

Note: For the uninitiated, Gordhop (in Bengali) is @$$/ mule/ donkey.

It's looking smart, isn't it?

Thanks to the Karnataka government for calling off the weekend curfew which had been imposed immediately after the 3rd wave of Covid swept throughout the state 🙏
It's such a blessing for nature lovers and photographers like myself.

Date of visit - 22nd January, 2022.

Place - Muthanallur Lake, Bangalore.
Distance - From my place in Electronic City in Bangalore, it's 10 kms approx.

Car in use: Hyundai Venue.

Unfortunately, the sunlight direction this morning was not very favorable hence a lot of birds aren't to be seen clearly.

Happy To Evict Karthik P from Indian Roadie on 2022-01-22

Karthik P would not have been approved to join India Roadie prior to 2021-11-10. Facebook supposedly wanted to make my life easy by leaving no option for me to reject stray people like him to join my initiative.
Karthik P is a retard with abnormal Social Media etiquette. He has to face the music soon.
I am Happy To Evict him (and more) as part of my ongoing Sanitizing Indian Roadie drive.

Binoy Balakrishnan wants to promote his business for free in Indian Roadie - Unsocial Face Of Social Media Users

Know one Binoy Balakrishnan of Kannur in North Kerala. He claims to be the MD of his own company which is into some chemicals business. I will henceforth be promoting him as a stubborn entity who wants to earn money for FREE! I spend hours building up Indian Roadie and all the associated forums as highly regimented entities.
With about 50,000 followers, Binoy can't stop salivating as expected. He has enough grey matter to understand that there's a 'bit of Indian Roadie in everybody's daily life'. Therefore, he is of the express opinion that he can promote his business to a huge captive audience free of cost.
As on 2022-01-22, it's the 5th (or maybe 7th) instance when he has tried to post a link to promote his own business to get attention. Everytime I have politely messaged him via Facebook Messenger requesting him to refrain from taking such shortcuts.
The sly freeloader has seen my messages but little does he know that I am not one of those guys with 'artificial intelligence'.
Over 50,000 people pan-India will now know the kind of businessman that he is.

Laid out a four course meal on the engine bay of my VW Vento for rats on 2022-01-21

Laid out a sumptuous spread of four course meal for obnoxious rats/ rodents to die because they play havoc with electrical wirings, insulation, rubber and plastic parts under the bonnet of cars.
The fresh servings at 1.45 pm on 2022-01-21 was a repetition of the previous servings three months ago in mid October 2021. Within 5 days after the previous serving, I saw crows tearing apart two fat rats lying dead on the road outside the garage. Immediately thereafter, there was a respite for 3 months.
Out of the four numbers of dark green Hit Rat Kill cakes/ mats served to them in October 2021, two had remained intact till 2022-01-19. However, when I opened the bonnet after starting the engine on 2022-01-21, I noticed that both the cakes were gone. It was a clear indication that rat(s) had cimbed the engine of my VW Vento within the past 48 hrs.
I replenished their fatal food today itself by placing four cakes at strategic points on the engine bay. I will keep a watch for 1 or 2 of those menacing devils to die within the next 7 days.

Drive out for brunch at Azad Hind Dhaba, Uluberia by Indian Roadie Nikhilesh Roy with friends on 2022-01-17

Brunch at Azad Hind Dhaba, NH16, Uluberia (40 kms from Victoria Memorial, Kolkata) with friends on Monday, 17/01/2022.
The sprawling dhaba with open air dining facilities and ample car parking is a perfect drive to destination which was introduced to us by Deep Banerjee about 6 years ago. The food and the ambience is too too too good.
Let the Covid situation improve a bit. We in Indian Roadie must drive out to this #IndianRoadiePreferredCafe for a day's outing.
