Ashok Gouroji, a resident of Yalakkisheatter colony in Dharwad, purchased a TVS Scooty Pep two-wheeler from dealer Sarur Motors on October 23, 2010 paying ₹67,500. Within a month of buying the rider found the vehicle to be defective as its engine would go off while in motion and there would be failure of brake frequently. He had approached the dealer with a complaint and the mechanics used used to fix the problem.
When the problems recurred at frequent intervals, Gouroji complained to the District Consumer Grievances Redressal Forum that frequent breakdown of the vehicle would put his life to risk and sought direction to the dealer to take back the vehicle and refund the money.
After hearing both the sides, the Forum decreed that there was a manufacturing defect and that the TVS Motors should refund the petitioner ₹50,000 (deducting the depreciation amount of ₹17,500 ), ₹2,500 as compensation towards the inconvenience suffered by the petitioner and ₹5,000 towards court expenses within a month of passing the order.
